How to Make a DVA Claim in Australia +

A no-bullshit guide to the DVA claims process for current and former ADF members.

What is a DVA Claim?

A DVA claim is a formal application to the Department of Veterans' Affairs to have a medical condition recognised as related to your military service. Once it's accepted, you get access to treatment, support, and compensation. That's it. That's the starting point for everything.

It doesn't matter whether you were Army, Navy, or Air Force. It doesn't matter whether you're still serving or you got out years ago. If your conditions are connected to your service, you may be eligible.

Who Can Make a DVA Claim?

You don't need to be discharged. Seriously. Both currently serving ADF members and veterans who've already separated can lodge claims. Your eligibility comes down to your service history and the conditions you're claiming for. Don't wait until you're out. Lodging while you're still serving means easier access to Defence medical records and a head start on getting your entitlements sorted.

The DVA Claims Process

1. Identify Your Conditions
This is where most people sell themselves short. Think about every single physical and mental health condition that could be connected to your service. Dodgy knees, busted shoulders, hearing loss, tinnitus, PTSD, anxiety, depression, skin conditions from living in the field. All of it. Don't downplay it and don't leave shit on the table.

2. Gather Supporting Evidence
You need medical evidence that links your conditions to your service. GP reports, specialist reports, service medical records. This is where a lot of claims fall over. A half-arsed submission with weak evidence is going to get knocked back. A well-prepared claim with strong supporting evidence has a much better chance.

3. Lodge Your Claim
Claims go to DVA through the MyService portal or paper forms. You'll need your personal details, the conditions you're claiming, and all your supporting medical evidence. Get it right the first time.

4. DVA Assessment
DVA reviews your claim, your service records, and your medical evidence. They might ask for more info or send you for additional assessments. Processing times vary, and honestly, it can take a while. Months, sometimes longer.

5. Decision
DVA will either accept or reject your claim. If accepted, your condition is officially recognised as service-related and you unlock access to treatment and potentially further compensation through Permanent Impairment claims.

Mistakes I See All the Time

Not claiming everything at once. I can't tell you how many veterans come to me having only claimed one or two things when they've got a dozen conditions that are clearly service-related. Don't be that person.

Submitting with weak evidence. This is probably the biggest one. DVA isn't going to accept your claim on vibes. You need proper medical evidence, and it needs to clearly link your condition to your service.

Giving up after a knockback. A declined claim is not the end of the road. It can often be reviewed or appealed with better evidence. Don't let one rejection stop you from getting what you're owed.

What is Permanent Impairment Compensation? +

How DVA lump sum compensation works and what it could mean for you.

What is Permanent Impairment?

Permanent Impairment (PI) compensation is a lump sum payment from DVA for the lasting impact your service-related conditions have on your life. It's separate from Initial Liability and it's on top of it. Think of Initial Liability as DVA saying "yep, your condition is service-related." Permanent Impairment is the compensation for how much that condition has screwed up your day-to-day life.

These can be significant payments. We're talking thousands, sometimes tens of thousands of dollars, depending on the severity of your impairment across all your accepted conditions.

Who is Eligible?

Your condition needs to already be accepted by DVA through an Initial Liability claim, and it needs to have reached a point where it's stable. DVA calls this "clinical stabilisation." Basically, it's not going to get significantly better. If that's the case, you may be eligible for a PI claim.

Straight up: if you've got accepted conditions and you haven't looked into PI, you could be leaving serious money on the table. It's worth a conversation at the very least.

How is it Assessed?

DVA uses a points-based system. Depending on which legislation applies to you (MRCA, DRCA, or VEA), the assessment framework is slightly different, but the principle is the same. A medical assessment determines the level of impairment for each accepted condition, and those points are combined to calculate your total impairment rating. The higher your total impairment, the higher your compensation. It's that straightforward.

Reassessments: Your Conditions Can Change

Here's something a lot of veterans don't realise. If your conditions have gotten worse since your last PI assessment, you can apply for a reassessment. And it happens more often than people think. Mental health conditions in particular tend to deteriorate over time, especially if you're not getting the right support. A reassessment can result in a significant additional lump sum. I've seen plenty of cases where veterans were sitting on worsening conditions for years without knowing they could get more compensation.

DVA Initial Liability Explained +

The foundation of every DVA claim. Here's what you need to know.

What is Initial Liability?

Initial Liability is the starting point for everything in the DVA system. It's DVA formally accepting that your medical condition is related to your military service. Without it, you can't access DVA-funded treatment, you can't get compensation, you can't do anything. It's the gateway.

So if you're a veteran or still serving and you've got conditions from your time in, getting Initial Liability accepted is step one. Everything else builds on top of it.

Why Does It Matter So Much?

Because once a condition is accepted under Initial Liability, you unlock:

DVA-funded medical treatment GP visits, specialists, allied health, medication. All covered by DVA for that condition. No out-of-pocket.

Permanent Impairment compensation A lump sum payment based on how much your condition impacts your life. This can be substantial.

Incapacity payments If your conditions affect your ability to work, there's financial support available.

Bottom line: Initial Liability is the key that unlocks everything else. Without it, you're locked out of the system. With it, you've got access to treatment, support, and compensation. Get it sorted.

Which Legislation Applies?

There are three main acts that cover DVA claims: MRCA (2004), DRCA (1988), and VEA (1986). Which one applies to you depends on your dates of service. The legislation affects what you can claim and how much you can receive. It's confusing as hell, honestly, and it's one of the main reasons veterans use an advocate.

What Conditions Can You Claim?

Any physical or mental health condition connected to your service. That includes conditions caused by service, conditions aggravated by service, and even conditions that developed because of treatment for another service-related condition. The list is longer than most people think. Hearing loss, tinnitus, knee injuries, back injuries, shoulder injuries, PTSD, anxiety, depression, alcohol use disorder, skin conditions. If it's connected to your time in uniform, it's worth looking into.

Retrospective Medical Discharge Eligibility +

One of the most misunderstood pathways in the DVA system. Here's the truth about what it is and who it's for.

What is a Retrospective Medical Discharge?

A retrospective medical discharge is a formal reclassification of how you were separated from the ADF. A lot of veterans were discharged without their conditions being properly recognised at the time. Maybe you were told to just push through. Maybe you downplayed your injuries because that's what everyone did. Maybe the system just failed you. Whatever the reason, a retrospective medical discharge corrects it. It changes your discharge category to reflect that you left because of medical conditions related to your service.

Why It's a Big Deal

This isn't just about recognition, though that matters too. Getting your discharge reclassified can unlock entitlements you never had access to. We're talking military superannuation invalidity benefits through ComSuper (MSBS or DFRDB). That can mean significant ongoing payments.

I've seen this process change people's lives. Veterans who spent years thinking they missed out on entitlements suddenly getting the recognition and financial support they should have had from day one. It's one of the most rewarding things I do.

Who Might Be Eligible?

If you were discharged from the ADF and had conditions at the time that were connected to your service but weren't properly recognised or assessed, you may be eligible. This happens a lot more than people think. Especially for those who served before the current medical discharge processes were in place, or for blokes and girls who just toughed it out and didn't complain. Sound familiar? It's worth a conversation.

The Application Process

You make a submission to the relevant service branch with evidence that you had service-related medical conditions at the time of your discharge. Medical records, service records, supporting statements. The evidence bar is high, and the process is complex. This isn't a DIY job for most people. Honestly, this is one of the most complicated pathways in the whole DVA space, and getting it wrong means going back to the start. That's why most veterans get an advocate involved.

What is ComSuper?

ComSuper, now run by CSC (Commonwealth Superannuation Corporation), manages military super schemes including MSBS and DFRDB. If you were medically discharged, you may be eligible for invalidity benefits through these schemes. These are ongoing payments, not lump sums, and they can be substantial.

DVA vs ComSuper: What's the Difference?

This is one of the most common things veterans get confused about, and honestly, the system doesn't make it easy.

DVA compensates you for specific service-related conditions. Initial Liability, Permanent Impairment, incapacity payments, and access to medical treatment. It's condition-specific.

ComSuper provides superannuation invalidity benefits based on your overall capacity to work. It's not about specific conditions. It's about whether your medical issues prevent you from working in civilian employment.

Here's the kicker: they're not mutually exclusive. You can claim both. Many veterans are entitled to DVA compensation AND ComSuper invalidity benefits. Having one doesn't disqualify you from the other. If someone told you otherwise, they were wrong.

Invalidity Classification

ComSuper invalidity benefits come in three tiers: Class A, B, and C. The classification depends on how severely your conditions affect your ability to work. Class A is the highest level of incapacity, Class C is the lowest. The tier you're placed on determines the percentage of your benefit entitlement. These can be reviewed over time, so if your situation changes, your classification can change too.

How They Work Together

DVA and ComSuper sit alongside each other, but there can be interactions, particularly around incapacity payments. It's not as simple as just claiming both and getting two full payments. The way they interact depends on your specific circumstances, which legislation applies, and what benefits you're receiving. Medical Separation from the ADF: What You Need to Know +

What is Medical Separation?

Medical separation is being discharged from the ADF because your medical conditions mean you can't meet the health standards required to keep serving. It can be initiated by Defence or by you, and it involves medical boards, paperwork, and a transition period. It's stressful as hell, and the process can feel like it's happening to you rather than something you have any control over. But you do have control over how prepared you are.

The Medical Separation Timeline

MEC Review
Your unit medical officer assesses your fitness for duty. If you're below the minimum standard, you'll be placed on a restricted MEC and referred for further assessment. This is usually where it starts.

Medical Board
A formal review board assesses whether your conditions are likely to improve and whether you can continue to serve in any capacity. If the answer is no, you're heading towards separation.

Transition Period
This is the critical window. Once the decision to separate is made, you've got a period before your actual discharge date. What you do during this time matters more than most people realise. This is when you need to get your DVA claims lodged, your medical evidence sorted, and your entitlements locked in.

Discharge
You're out. You transition to civilian life with whatever entitlements you've managed to set up. If you've done the work during transition, you're in a good position. If you haven't, you're playing catch-up for years.

Why the Transition Period Matters

I cannot stress this enough: do not wait until after you're discharged to start sorting your DVA claims. The transition period is your golden window. Use it. Every single week you waste is a week you could have been getting your shit together. Many veterans leave the ADF without having lodged their claims, without proper medical documentation, and without understanding what they're entitled to. That leads to years of missed entitlements and a much harder process later.

What to Do If You're Medically Separating

Lodge your DVA claims NOW. Not after discharge. Not next month. Now. While you still have access to Defence medical services and records.

Get proper medical documentation for everything. Every condition, every symptom, every specialist. Comprehensive documentation now saves you massive headaches later.

Understand your superannuation. MSBS or DFRDB invalidity benefits could be significant. Don't assume someone else is sorting this for you.

Get an advocate involved early. The earlier you start, the better your outcome. I've seen the difference between veterans who came to me six months before discharge versus six months after. It's night and day.
